Dual occupancies (Duplex's) are a great way to maximise the return and increase the value on a single block of land. This type of development is most usually permissible within Residential and some Rural Zones, dependant on your Local Government Area. Under your Local Council's controls such as the Local Environmental Plan (LEP) and Development Control Plan (DCP) there are a range of controls that determine the suitability of our site for a Dual Occupancy Development.
What if your Council does not permit Dual Occupancy Development? This could greatly reduce the time spent waiting for a Development Application (DA) approval and subsequent Const uction Certificate (CC) Approval.
What to look for
To determine whether your site permits Dual Occupancy Development under the State Environmental Planning Policy it would need to comply with the following:
1. Does the Exempt and Complying Development Codes (State Environmental Planning Policy (Exempt and Complying Development Codes) 2008) apply to your land?
2. Are you in an R1, R2, R3, R4 or RU5 Zone and are Dual Occupancies permissible under your relevant Zoning?
3. Is your site greater than 400m2 or the minimum lot area as specified for Dual Occupancies under the LEP?
4. Is your siteat least 15m wide or 12m wide if it is a corner site or has a laneway with vehicular access?
